Terms of Service

1. Agreement

By accessing or using avenirpm.ai and the Avenir AI service, you agree to these Terms of Service. If you do not agree, do not use the service. Avenir AI is offered to United States customers only.

2. Service description

Avenir AI provides an AI-powered leasing assistant (“Alex”) that handles inbound voice and text inquiries, along with a dashboard platform for property managers to review conversations and manage leads, maintenance requests, and tenant communications.

3. Eligibility

You must be at least 18 years old and, if you are using the service on behalf of a property management entity, authorized to bind that entity to these terms.

“Customer Content” means anything you, your team, your tenants, or your prospects submit to the service — including lead inquiries, voice and text conversations, photos, listing details, and any data you upload from a property management system. You retain all rights, title, and interest in your Customer Content.

By using the service, you grant Avenir Ventures LLC a limited, non-exclusive, worldwide, royalty-free license to host, copy, process, transmit, and display Customer Content solely as needed to operate, secure, and improve the service for you. We may use de-identified or aggregated data to improve the service, but we do not use Customer Content to train shared third-party AI models. You represent and warrant that you have the necessary rights and consents to provide the Customer Content to us.

6. Email inbox access

If you elect to connect a Gmail or Outlook inbox, you authorize Avenir to access and process emails from that inbox solely to identify, draft, send, and act on property-related communications. Authorization is granted through your provider's OAuth flow and may be revoked at any time from the Avenir dashboard or your email provider's security settings. You confirm that you have authority to grant this access for the inbox you connect. Further detail on what we read, how long we retain it, and how to revoke access is in our Privacy Policy.

7. SMS / messaging terms

Avenir Ventures LLC d/b/a Avenir AI offers the following SMS messaging programs:

Frequency: message frequency varies based on your account activity. Rates: message and data rates may apply; check with your wireless carrier for plan details. Help: reply HELP to any message or email hello@avenirpm.ai. Opt-out: reply STOP, END, CANCEL, QUIT, or UNSUBSCRIBE to any message to opt out of that program; you will receive a final confirmation, and no further messages from that program will be sent. Carriers: wireless carriers are not liable for delayed or undelivered messages.

8. Payment

Setup fees and monthly subscription amounts are as quoted at the time of signup. Setup fees are non-refundable. Monthly subscriptions may be cancelled with 30 days' written notice to hello@avenirpm.ai.

9. AI limitations

Alex is an AI system. It may occasionally produce inaccurate, incomplete, or unexpected output, and AI systems can “hallucinate” or misinterpret a question. Property managers and owners remain solely responsible for final decisions on leasing, pricing, screening, maintenance, evictions, tenant communications, and compliance with applicable law. Alex's output is not legal, financial, or professional advice. We strongly recommend reviewing Alex's decisions periodically and configuring escalation rules so that consequential matters are routed to a human.

10. Disclaimer of warranties

The service is provided “as is” and “as available” without warranties of any kind, whether express, implied, statutory, or otherwise. To the fullest extent permitted by law, Avenir Ventures LLC disclaims all warranties — including but not limited to merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from course of dealing or course of performance. We do not warrant that the service will be uninterrupted, error-free, or free of viruses or other harmful components, or that any errors will be corrected.

11. Limitation of liability

To the fullest extent permitted by law, Avenir Ventures LLC and its affiliates, suppliers, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including loss of profits, lost data, business interruption, or loss of goodwill — arising out of or related to the service, even if we have been advised of the possibility of such damages. Our total cumulative liability for any claim arising out of or related to the service is limited to the fees you paid us in the 12 months preceding the event giving rise to the claim.

12. Termination

Either party may terminate this agreement with 30 days' written notice. Upon termination, a data export of your conversations and leads will be made available upon request for up to 60 days, after which your data will be deleted from active systems. We may suspend or terminate your account immediately if you breach these terms or use the service in a way that creates legal or operational risk.

13. Copyright / DMCA

We respect the intellectual property rights of others. If you believe that material on the service infringes a copyright you own, you may submit a takedown notice under the Digital Millennium Copyright Act (17 U.S.C. § 512) to our designated agent at hello@avenirpm.ai. Your notice must include: (a) your physical or electronic signature; (b) identification of the copyrighted work claimed to be infringed; (c) identification of the material claimed to be infringing and where it is located on the service; (d) your contact information; (e) a statement that you have a good-faith belief the use is not authorized; and (f) a statement, made under penalty of perjury, that the information is accurate and that you are authorized to act on behalf of the owner.

14. Feedback

If you send us suggestions, ideas, or other feedback about the service, you grant Avenir Ventures LLC a perpetual, irrevocable, royalty-free, worldwide license to use, modify, and incorporate that feedback into our products without obligation to you.

15. Changes to these terms

We may update these terms from time to time. If a change is material, we will provide at least 30 days' notice — by posting a notice on the service, by email, or both — before the change takes effect. What is “material” is determined in good faith. By continuing to use the service after a change becomes effective, you agree to the updated terms.

16. Severability and waiver

If any provision of these terms is held to be unenforceable or invalid, the remaining provisions will remain in full force and effect, and the unenforceable provision will be interpreted to most closely accomplish its original objectives. Our failure to enforce any right or provision will not be considered a waiver of that right or provision.

17. Governing law

These terms are governed by the laws of the State of Arizona, without regard to its conflict-of-law provisions. Any dispute arising out of or related to these terms or the service will be resolved in the state or federal courts located in Maricopa County, Arizona, and you and Avenir Ventures LLC consent to the exclusive jurisdiction of those courts.
